THE PLAN

A. You have chosen to purchase an Airtel iPhone plan under Airtel’s ‘iPhone For Life’ scheme on loan from Bajaj Finance Limited (“BFL”) from among the plans specified in Annex A (Plan). The Plan entitles you to purchase and use an iPhone device (Phone) selected by you from among the variants described in Annex A. Purchase of the Phone is subject to applicable terms and conditions and additional payments.

B. Activation of the Plan is subject to you fulfilling our subscriber verification criteria, and filling out the attached Customer Acquisition Form (CAF) and Tariff Enrolment Form (TEF).

C. As a pre-requisite, the Plan requires that you purchase the Phone by providing the required loan documentation to BFL and to permit Airtel to directly debit the cost of the Plan and the Equated Monthly Instalments (“EMIs”) of the loan availed by you from BFL from your bank account. To enable this, you agree to fill in and sign Electronic Clearance Scheme (ECS) forms.

D. The Plan will be activated upon us successfully verifying your credentials as per our subscriber verification criteria. If you are activating the Plan on your existing Airtel mobile number, activation will immediately terminate any other plan that was active on your Airtel mobile number.

E. You commit to remain enrolled with the Plan for 12 months (Plan Period).

F. If you wish to change the tariff Plan before the Plan Period, you may only choose one of the other tariff plans described in Annex A.

G. Any use of the Plan beyond the Plan entitlement will be charged at Airtel’s default tariffs specified in the Tariff Enrolment Form or on our website www.airtel.in. You acknowledge that you have viewed these tariffs and agree to the same. Excess use will be billed to you separately and you agree to pay these to Airtel within the specified due date as per your billing cycle.

H. If you expect your use to exceed the Plan entitlement, you may also select any booster pack that may be available from time to time.

I. After the Plan Period, the Plan will terminate automatically and you will be required to choose from any other Airtel tariff plan that may be then available (please note that your earlier plan may no longer be available).

J. The Plan cannot be combined with any other offer or scheme that may be available.

K. If the Phone is damaged, destroyed or lost during the Plan Period, you will continue to remain liable to pay the Plan tariff for the rest of the Plan Period.

THE PHONE

L. At the end of 12 months, you may choose any of the following options within 30 days of the end of the 12-month Plan period:

  • a. Return the Phone to the outlet from where it was originally purchased. The Phone must meet the return criteria specified in Annex B and the same will be determined at the sole discretion of the outlet. Upon acceptance of the Phone by the outlet, this contract will terminate. You understand and accept that such termination will also require you to comply with the terms under your loan agreement with BFL for the Phone,
  • b. Upgrade to the latest Apple iPhone available at that time by returning the Phone to the outlet from where it was originally purchased, meeting the criteria of return as listed in Annex B and signing up to a new tariff plan, as may be available then. If you choose this option, this contract will terminate and you may be required to sign up to fresh terms.

M. If you do not opt for one of the above options within the period specified in Clause L, you acknowledge and accept that BFL will debit your bank or credit card account or take such action as it deems fit under the terms of the loan agreement for the residual value of the Phone after 12 months (“Balloon Payment”) as specified in Annex A, and you may retain the Phone. However, you will be required to choose a different Airtel plan as specified in Clause I above. If you choose option (a) and the Phone does not meet the criteria specified in Annex B (which will be determined at the absolute discretion of the accepting outlet), the Balloon Payment of the Phone as specified in Annex A will be auto debited by BFL as specified in Clause N below, and you may retain the Phone.

DEFAULT

N. You agree not to default on payments to Airtel during the 12-month Plan period. Default also includes the following:

  • a. Your repudiation of this contract.
  • b. Your failure to pay the committed Plan tariff during any month(s) of the committed 12-month Plan period.

  • f. Your conversion from postpaid to prepaid.
  • g. Activation of safe custody on your phone number.
  • h. Your transfer of ownership of the Plan or the Phone before 12 months.

O. If the auto-debit fails for any reason, you agree to immediately pay the monthly Plan amount to Airtel through alternate means such as payment through our website www.airtel.in, cheque deposit or cash payment at an Airtel outlet. If you do not make such payment within 7 days of the designated auto-debit date, you will be in default.

P. Upon your default, besides initiating our recovery process, we will also be required to inform BFL (and you hereby consent to the same) and BFL may designate you as a defaulter and take independent action against you in accordance with the consumer loan agreement. You agree to indemnify Airtel from any consequence to Airtel resulting from any action taken by BFL due to your default. You will however, continue to remain liable to Airtel for the entire tariff committed for the 12-month Plan period.
